Services Offered:

October Visuals provides professional real estate and media production services, including:

  • HDR photography

  • Aerial drone photography and videography

  • 2D floor plans

  • Lux property videos

  • Twilight photo/video edits

  • Single listing websites

Exclusions:

Services do not include post-project revisions, song changes, or additional editing unless explicitly agreed upon in writing or included in the original scope of work.

How to Book:

Clients may book services through our website or by direct contact. Bookings are confirmed once all required details are submitted.

Payment Terms:

  • Invoices are sent after deliverables are released.

  • Payment is due upon receipt.

  • Late payments incur a $25/month late fee after 15 days.

  • Accounts overdue 45+ days will result in a hold on future services and deliverables.
    Balances over 90 days past due will be referred to collections.

Packages:

If purchasing a package, an invoice will be sent after the first round of deliverables (i.e., photos, drone photos, floor plan). Allow additional time for video deliverables.

Property Readiness:

The client is responsible for ensuring the property is “camera-ready” before the scheduled appointment. This includes cleaning, organizing, and staging.

  • If the property is not ready, it will be photographed or filmed “As Is.”

  • Client feedback is welcome, either in person at the start of the appointment or via notes in the order form.

  • In the absence of direction, the October Visuals team will use their professional judgment.

Order Accuracy & Pricing:

Clients must provide accurate property details at the time of booking. If reported information (ex., square footage) is incorrect, pricing and order details may be adjusted accordingly.

Cancellation & Rescheduling:

  • Cancellations or reschedules within 12 hours of the appointment are subject to a $25 fee.

  • Weather-related rescheduling (e.g., drone restrictions due to wind or rain) will not incur a fee.

  • If the client chooses to proceed in poor weather, a $25 trip fee will apply for any required return visit for aerial shots.

Refund Policy:

All sales are final.
Refunds will not be issued except in cases where October Visuals fails to deliver due to circumstances within our control.

No refunds will be provided for:

  • Change of mind after services begin
    Delays or lack of communication from the client

  • Completed and delivered services

Revisions:

  • Minor revisions may be requested within 7 days of delivery.

  • Additional revisions after that period may incur fees.

  • Clients may provide a preferred music track up to 24 hours after filming. If none is provided, October Visuals will select one. Once chosen, music cannot be changed.

Delivered Next Business Day (by 6 PM):

  • HDR Photography

  • Aerial Photography

  • 2D Floor Plan

Delivered Within 2–3 Business Days:

  • Lux Video

  • Twilight Edits

Service Area & Travel Fees:

Travel up to 100 miles round-trip from Raleigh, NC is included.
Beyond that, a $1 per mile fee applies, calculated round-trip.

Hosting:

  • Single listing websites are hosted for one year from the appointment date.

  • After the hosting period, clients are responsible for storing and maintaining their media assets.

Grant of Rights:
By engaging October Visuals, you grant us a non-exclusive, perpetual, transferable, sublicensable license to create, use, display, and distribute resulting media (photos, videos, floor plans, etc.) across all platforms.

October Visuals Retains Ownership and Copyright of all media.
We reserve the right to use any created content for:

  • Portfolio or website samples

  • Marketing and promotional materials

  • Social media

  • Industry awards or exhibitions

  • Distribution through affiliates or partners

Client License:

Clients receive a non-exclusive, non-transferable, unlimited-time license to use the media for marketing the listed property, their real estate business, and brokerage. Media may be used on third-party platforms (MLS, Zillow, etc.) only while the listing is active. All third-party authorization ends once the listing is no longer for sale or the agreement terminates.

Legal Clearances:

By using our services, you confirm that you have obtained all necessary permissions from:

  • The property owner

  • Individuals or entities with design or visual rights

You also confirm that property occupants have waived privacy expectations regarding visual media captured under this agreement.

Liability & Indemnification:

October Visuals takes all reasonable precautions to ensure equipment and quality standards.
However, we are not liable for delays or service interruptions caused by equipment failure, weather, or site access issues.

Indemnification:

Clients agree to indemnify and hold harmless October Visuals, LLC and its representatives against any liability, claims, or damages resulting from:

  • Failure to obtain necessary permissions

  • Unauthorized use of media beyond the granted license

  • Client negligence or omissions

Privacy Policy:

Clients may request access, correction, or deletion of their personal information (subject to legal and contractual requirements). October Visuals reserves the right to update this Privacy Policy at any time. Continued use of our services constitutes agreement to updated terms.

Governing Law:

This agreement is governed by the laws of the State of North Carolina.
Any disputes will be handled within the jurisdiction of North Carolina courts.

Changes to Terms:

October Visuals, LLC reserves the right to update or modify these terms at any time.
Clients will be notified of any significant changes. Continued use of services implies acceptance of the revised terms.

Acceptance of Terms:

A checkbox or signature at the time of booking confirms the client’s acceptance of these Terms & Conditions.
